Statement by the Leader of the FRETILIN Parliamentary Group, Aniceto Guterres, on the debate and Vote on General Budget of the State
People of Timor-Leste
The debate in the specificity which we have all witnessed in this national Parliament over the last days in this National Parliament has continued to arouse concerns in our FRETILIN Group with respect to the proposed General Budget of the State for the period 1 July to 31 December 2007, and with respect to which all of us parliamentarians are about to undertake a final and global vote on.
I would like to restate to everyone that the concerns expressed by us in our FRETILIN Groups political declaration yesterday (7 October 2007) remain valid to us and are maintained by us, with the exception of our statements relating to the issue of the veterans and the illegality of the Secretary of State for the Autonomous Region of Oecusse.
Still a big concern for us is the budget allocation for the establishment of a Task Force to Combat Poverty in the Office of The President of the Republic, a budget for which there has been neither any explanation nor justification given to us. None of us know for what purpose it is proposed to spend this money. Is it perhaps simply for distribution to the poor? If so, is this the effective means of combating poverty? Or will it simply create dependency which will forever impede people from rising out of poverty? Perhaps it will be for holding Open Presidency meetings over the next two months?
The government as the executive has the primary responsibility to combat poverty through its development program. Although the President of the Republic has a political responsibility to involve himself with this issue as with many others, because we have not been provided with any justification on the proposal, we can only say that it seems to us to simply be a proposal for a slush fund for arbitrary expenditure. This would result in the Presidency acting in a manner which would not be in keeping with the principles of transparency and accountability.
We were extremely saddened by the parliaments decision to authorise the government to transfer USD$40 million from the Petroleum Fund, disregarding the procedures established in the Petroleum Fund law to obtain prior approval from the Independent Petroleum Fund Consultative Council. This has resulted in a negative precedent for Timor-Leste which had previously been widely internationally recognised for its strong commitment to the fundamental principles of transparency and accountability in the management of the peoples petroleum revenues.
This has also illustrated that this de facto government has no commitment to reform or change as they had previously widely proclaimed during the lection campaign.
We all acknowledge that the issue of the internally displaced persons in our country is an extremely urgent and important issue for us all. In the past all political parties who are now represented in this parliament promised to resolve the issue of the displaced persons in the short term and criticised the previous FRETILIN for not having done so. They thought they could perform miracles. Now they are telling us we have to be realistic, and have allocated a meagre USD$2 million towards assistance for displaced persons, for such things as purchasing of new tents for them. It is clear that people who have already been living under tents for a long time now will have to continue to live under tents.
Our proposals for additional funding to provide assistance for and attempt to resolve the issue urgently was defeated by the de facto government and their proxies in the parliament.
On one hand they are saying that there is an existing lack of capacity to execute such a large amount on displaced persons in such a short period of time, but on the other hand we see them proposing to spend a very large amount of money on goods and services, even though they do not have a plan for its execution. From this we can clearly already see that they lack honesty, they do not have a moral conscience, they have already lost their sensitivity to these people who are undergoing hardship in our country. They have shown they do not serious on the issue of the displaced persons because they have failed to give them due importance in this budget.
Due to all of these concerns the FRETILIN Parliamentary Group opposes this law on the General Budget of the State.
Lastly, we hold grave concerns as to how they will execute such a large budget in such a short period of time involving an unduly large amount of money, even though it will simply involve spending. The FRETILIN Parliamentary group strongly doubts this Governments capacity to execute this budget. As this de facto Government says it can execute all of it, and are rejecting the need to reduce the large amount allocated to goods and services, we will expect there to be no carryovers, as they demonised the previous FRETILIN government for having previously done. Otherwise, we will expect that we will all turn out to in fact be devils and in doing so illustrating this de facto governments in capacity to govern, and that in accordance with what His Excellency Mr. Kay Rala Xanana Gusmão said: Whoever steals even a quarter (25 cents), out! Whoever cannot do his job, out! Whoever does not know how to govern, out!!
FRETILIN will expect this de facto government to comply with its promise in this regard, in January 2008.

Minister threatens to sack foreign judges
Timor Leste's new government has renewed its attack on the
independence of the judiciary, with Minister of Justice Lucia Lobato
threatening to terminate the contracts of United Nations-appointed
foreign judges 'who are not performing well.'
FRETILIN Member of Parliament Domingos Sarmento today called on
Lobato to withdraw her threat and apologise to the judiciary. "If
sherefuses to apologise then Prime Minister Gusmao must dismiss her
from the ministry," said Sarmento, a former Justice Minister and
liberation fighter.
In an interview with Timor Leste television TVTL on 3 October,
Minister Lobato said her government would 'evaluate the
performance'of foreign judges and terminate the contracts of those
who were not performing well.
Domingos Sarmento said: "It is not the government's role to pass
judgement on the work of the judiciary. That is the job of the
Superior Council for the Judiciary mandated as an independent body
under the constitution."
Sarmento said Lobato appeared determined to interfere with the
judicial process relating to Alfredo Reinado, the army mutineer and
prison escapee who led an armed band in a violent coup attempt
against the FRETILIN government last year.
The Dili newspaper Suara Timor Lorosae on 3 October reported Lobato as
saying the government had 'formed a task force to find a solution
acceptable to all parties, including Alfredo Reinado.'
A United Nations Independent Special Commission of Inquiry in
October 2006 recommended Reinado be prosecuted for his role in
leading an attack on government troops in which five people were
killed and 10 seriously injured. Reinado remains at large but he and
his co-accused have been indicted and are scheduled to be tried in
December this year.
Domingos Sarmento said:" Minister Lucia Lobato appears to understand
nothing about the separation of powers and shows no respect for the
independence of the judiciary.
"Reinado's case ought to be judged according to law and proper
judicial procedure and not by a process of negotiation between the
fugitive and politicians who have benefited from his support."
Sarmento said Minister Lobato took her first swipe at the judiciary
on the first day of the new government, 8 August, when she blocked
ajudge's order allowing a jailed former minister to travel abroad
for medical treatment.
"Minister Lucia Lobato prevented the former minister's aircraft from
leaving Dili and then tried to insist that the former minister's two
children remain in Timor Leste as virtual hostages pending his
return from treatment.
"The judge who issued the order, Justice Ivo Rosa had to issue a new
direction saying the Justice Minister could be in contempt of court
if she prevented the former minister from travelling.
"The new government's actions are in sharp contrast to the former
FRETILIN government which scrupulously avoided interfering with the
justice system," Sarmento said.

FRETILIN demands an end to political interference in Railos case
FRETILIN today welcomed the arrest of a key figure in last years violent coup attempt against the former FRETILIN government and demanded that the new government allow the judiciary to conduct the investigation and trial without further political interference.
FRETILINs parliamentary leader Aniceto Guterres said he hoped a thorough investigation and trial of Vicente da Conceicao, alias Railos, would identify other key players in the coup attempt.
United Nations (UNPOL) and Timorese police arrested Railos yesterday after FRETILIN General Secretary Mari Alkatiri told the UNPOL commander last Friday that if UNPOL did not arrest Railos then FRETILIN militants would do so and hand him over to UNPOL unharmed.
A United Nations Independent Special Commission of Inquiry in October last year recommended Railos be prosecuted for his role in leading an attack on an army barracks on 24 May 2006 in which as many as nine people were killed, and for the illegal possession, use and movement of weapons.
Aniceto Guterres said today Railos was arrested on a warrant issued on 13 September 2007.
Guterres said: Railos has been allowed to go free for a year thanks to protection from senior politicians including (former President and now Prime Minister) Jose Alexandre Gusmao.
Gusmao openly used Railos as his partys campaign co-ordinator in the recent parliamentary elections where Railos intimidated voters in the Liquica and Ermera districts.
Guterres pointed to a report by the European Union Election Observation Mission on the parliamentary election in June this year which stated that: As already stated in the preliminary statement issued after the second round of the presidential elections, the EU EOM is concerned with the involvement of Vicente da Conceição, a.k.a. Rai Los, as CNRT campaign coordinator in the district of Liquiçá, despite having been recommended for prosecution on criminal charges by the United Nations Independent Special Commission of Inquiry for Timor-Leste, created to investigate the events that led to the May 2006 crisis (http://www.eueomtimorleste.org/parl/PDF/EUEOM%20TL%20Parliamentary%20Elections%20FINAL.pdf)
Guterres said: FRETILIN believes a thorough investigation and trial of Railos will help reveal those behind the armed coup against the FRETILIN government. It was Railos attack on the Timor Leste army, along with attacks against the State by army fugitive Alfredo Reinado and Deputy Police Commander Abilio Mesquita which helped bring the government down.
On the 27th of September 2007 FRETILIN tabled in parliament a copy of a letter from then President Gusmao and then police commander Paulo Martins, now a Gusmao-aligned member of parliament, dated 29 May 2006 which stated that as Railos and his group were undertaking "official duties", they were to be allowed to move unimpeded throughout Timor Leste.
At the time, Railos and his group were armed and had just participated in the attack against the Timor-Leste army on 23-24 May 2006.
The signed letter allowed Railos to possess firearms despite then President Gusmao having signed an agreement inviting international forces into Timor-Leste on the basis that all groups be disarmed including the police.
It shows that Gusmao was using Railos for his own unlawful purposes because as President of the Republic he had no authority to allow Railos to be armed. This is another example of blatant contempt of the rule of law by Gusmao.
This letter of safe passage allowed Railos to systematically intimidate voters in the Liquica, Ermera and Bobonaro Districts. He was also able to meet with an Australian Broadcasting Corporation television crew and participate in a Four Corners program, which was used to broadcast false and defamatory allegations that former Interior Minister Rogerio Lobato and Mari Alkatiri had armed civilians to eliminate political opponents.
As we now know, Railos allegations were false. The investigation found no evidence against Dr Alkatiri and the trial of Rogerio Lobato found that while he did arm civilians, his purpose was to support the police when the institutions of state were under attack from armed rebels.

A FRETILIN exige que se pare com a interferência política no caso de Railos
A FRETILIN congratulou hoje a prisão de uma figura chave do violento golpe do ano passado, e exigiu que o governo inconstitucional permita que a judiciária conduza a investigação e o julgamento sem que haja inteferência política.
Aniceto Guterres, Chefe da Bancada parlamentar da FRETILIN, afirmou que espera que uma completa investigaçao e o julgamento de Vicente da Conceição "Railos" possam indentificar as outras figuras chave da tentativa de golpe.
A Polícia das Nações Unidas (UNPOL) e a Polícia de Timor-Leste (PNTL) efecturam ontem a prisão de Railos, depois do Secretário Geral das FRETILIN, Mari Alkatiri, ter dito na sexta feira passada, ao comandante da UNPOL, que caso a UNPOL não prendesse Railos, os militantes da FRETILIN iriam efectuar a prisão e entregá-lo desarmado à UNPOL.
A Comissão Especial de Inquérito das Nações Unidas recomendarem, em Outubro de 2006, que Railós fosse processado pelo seu papel de liderança no ataque à um quartel militar no dia 24 de Maio de 2006, no qual cerca de nove pessoas foram mortas, e pela posse, uso e movimento ilegais de armas.
Aniceto Guterres disse hoje que Railos foi preso com um mandato de captura emitido no dia 13 de Setembro de 2007.
Aniceto Guterres afirmou: "Railos pode andar livre por um ano, graças à protecção dad por líderes políticos séniores, incluindo (ex Presidente da República e actual Primeiro-Ministro do Governo Inconstitucional) José Alexandre Gusmão.
"Gusmão usou Railos durante a campanha política do seu partido, como co-cordinador, duante a recente eleição legislitava, onde Railós intimidou o eleitorado nos distritos de Liquiça e Ermera."
Guterres mencionou um relatório, feito pela Missão de Observadores Eleitorais da União Europeia (EU EOM), durante as eleições legislativas em Junho do corrente ano, no qual está declarado que: "Como ja havia sido dito na declaração preliminar, emitida após a segunda volta das eleiçòes Presidenciais, a EU EOM está preocupada com o envolvimento deVicente da Conceição, também conhecido por Railos, como coordenador de campanha do CNRT no distrito de Liquiça, apesar de ter sido recomendado para processo criminal pela Comissão Especial de Inquérito das Nações Unidas para Timor-Leste, criada para investigar os acontecimentos que conduziram à crise de Maio de 2006" (traduzido). Guterres disse també que: "A FRETILIN acredita que uma investigação completa e o julgamento de Railos irão ajudar a revelar os que se encontram por trás do golpe armado contra o Governo da FRETILIN. Foi o ataque de Railos às Forças Armadas de Timor-Leste, juntamente com os ataques contra o Estado, feitos pelo fugitivo Alfredo Reinado e Comandante Adjunto da PNTL Abilio Mesquita, que ajudaram a deitar abaixo o governo.
"No dia 27 de Setembro de 2007, a FRETILIN apresentou ao Parlamento Nacional uma cópia de uma carta (Guia de Marcha) assinada por, na altura, Presidente Xanana Gusmão e Comandante da PNTL Paulo Martins, que é agora um deputado do partido de Gusmão, datada de 29 de Maio de 2006, onde declarava que Railos e seu grupo estavam a efectuar "trabalhos oficiais",e que não deveriam ser impedidos de circular por todo Timor-Leste.
"Na altura, Railos e o seu grupo encontravam-se armados, e haviam participado num ataque contra as Forças Armadas de Timor-Leste, no dias 23 e 24 de Maio de 2006.
"O Guia de Marcha permitiu que Railos possuisse armas, apesar de o na altura Presidente Gusmão ter assinado um acordo a convidar as forças internacionais para Timor-Leste, e que todos os grupos deveriam ser desarmados, incluindo a polícia.
"Demonstra que Xanana Gusmão estava a usar Raio para alcançar os seus objectivos, de forma ilegal visto que como Presidente da República não tinha qualquer direito para permitir que Railos andasse armado. Isto é outro exemplo da forma de governação espalhafatosa de Xanana Gusmão.
"Essa Guia de Marcha permitiu que Railos intimidasse, de forma sistemática, o eleitorado nos distritos de Liquiça, Ermera e Bobonaro. Permitiu também que se encontrasse com uma equipa da emissora televisiva Australian Broadcasting Corporation (ABC) e participou no programa Four Corners, que foi usado para transmitir acusaçòes falsas e difamatórias de que o es Minsitro do Interior Rogerio Lobato e o ex Primeiro Ministro Mari Alkatiri haviam armado civis para eliminarem os seus adversários políticos.
"Como sabemos, as alegações de Railos eram falsas. As investigações não encontraram qualque evidência contra o Dr Alkatiri, e durante o julgamento de Rogerio Lobato foi-se descoberto de embora tenha armado civis, o seu objectivo era apenas de apoiar a polícia, visto que asinstituições de Estado estavam sob ataques por rebeldes armados."

Adaljiza Magno
Adaljiza Albertina Xavier Reis Magno was born in Baguia, January 7,
1975 to Ana Xavier G. Magno and Alberto dos Reis Magno. Adaljiza was
only 11 months when Indonesia invaded Timor-Leste. Her family escaped
to Mount Matebian with FRETILIN for 4 years before returning to Baguia
in 1979. In 1980 they surrendered to the Indonesia army due to the
food scarcity and malnutrition at that time.
Adaljiza married Rosantino Amado Hei dos Anjos in October 2003. The
couple has one baby daughter, Rosejiza Nabilan Magno Hei.
Adaljiza is a FRETILIN member and was the former Vice Minister of
Foreign Affairs and Cooperation in the First and Second Constitutional
Governments and acting Minister of Foreign Affairs and Cooperation in
the Third Constitutional Government.
Education and Qualifications
Adaljiza attended primary school from 1982-87, pre-secondary school
from 1987-90 and secondary school from 1990-93 in Dili. She graduated
with a degree in Economics from the Sebelas Maret National University,
Surakarta, Indonesia.
Professional Career
Adaljiza was elected to represent FRETILIN in the Constituent Assembly
in September 2001 to May 2002, and served in the first National
Parliament from 2002 until July 2005. At 26 years old Adaljiza was
the youngest member of the Constituent Assembly. Adalgiza was also
appointed the Secretary of the National Parliament's Committee of
Economic and Finance.
In 2005, Adaljiza attended the 4th meeting of the CPLP Parliament and
she has attended several meetings related to the Petroleum Fund
organized by NORAD in Oslo, Norway.
In July 2005 Adaljiza was appointed the Vice Minister of Foreign
Affairs and Cooperation in the First Constitutional Government and at
30 years of age, was the youngest member of the government.
Political Activities
Before being elected to the Constituent Assembly, Adaljiza was one of
Timor-Leste's vocal women activists. She became involved in the
student movement for Timor-Leste's independence whilst completing her
university studies in Indonesia.
Adaljiza was a member of the Catholic Students of the Republic of
Indonesia Organization (PMKRI) in Surakarta from 1993 to 1998 and she
joined the SAHE Study Club based in Jakarta, Indonesia in 1998. It was
during this time that Adaljiza and her colleagues also established the
Communication Forum for Timor Lorosae's Women (FORELSAN), in
Yogyakarta, Indonesia.
Adaljiza returned to Timor-Leste in 1999 during the UN supervised
independence referendum. When the result was announced, the
pro-autonomy militias with Indonesian military support systematically
carried out an intense campaign of violence and intimidation that
resulted in major destruction of Timor-Leste; the displacement of
hundreds of thousands of civilians; and in over a thousand citizens
killed. Adaljiza and her family were among those forced to flee across
the border to Kupang in West Timor. They remained in the refugee camps
there for a week, before moving to Bali as a result of continued
militia intimidation of the refugees. Adaljiza and her family returned
to Timor-Leste after the arrival of the UN endorsed International
Peace Keeping Force in October 1999.
Following Timor-Leste's independence from Indonesian military
occupation, Adaljiza resumed her activism. Her commitment to working
for social change, justice and the restoration of people's dignity
mixed with her capability and analytical mind led her to be selected
to represent the Timor Labor Union at the 88th Session of the ILO
International Labor Conference in Geneva, Switzerland in 2000. During
that same year she was a representative of the NGO East Timor Action
Network (ETAN) on a speaking tour that visited 22 states in the USA.
She delivered lectures in various universities including Yale
University, Colombia University, Stanford University, University of
California at Berkeley, and City University of New York on topics such
as the East Timorese independence struggle, women's issues and
justice.
In 1999 Adaljiza co-founded the 'Sahe Institute for Liberation' (SIL),
a popular education NGO in Dili and remained with SIL until 2001 when
she was elected to the Constituent Assembly. She was the Head of
Advocacy Division in SIL from June 1999-September 2001. In November
1999 Adaljiza was a volunteer with HAK, a human rights association, as
their Popular Education Coordinator until June 2000. Adaljiza lectured
in Human Rights at the National University of Timor-Leste (UNTL) in
2000.
From November 1999 until June 2000, Adaljiza joined the advocacy
division of the local NGO, the Communication Forum for East Timor
Women (FOKUPERS). In 2001, she was appointed to the organizing
committee to establish Rede Feto Timor-Leste (East Timor Women's
Network). She acted as a consultant to UNFPA from June-August 2001 on
the report on Domestic Violence in Timor-Leste.
Adaljiza currently serves as a Board member of two civil society
organisations, namely HAK Association from 2002 till 2006 and FOKUPERS
from 2004 until 2007. This year, she represented the civil society
organizations at the 3rd East Timor donors meeting in Canberra,
Australia.
In 2003, Adaljiza represented FRETILIN in an exchange program to the
People's Republic of China, which focused on politics, culture,
economics, and history.
Adaljiza has also written various published articles on justice, women
and the economy.
Adaljiza is fluent in Tetum, Portuguese and Macasae (dialect from
Baucau) Bahasa Indonesia, and English.
